These Terms & Conditions apply when you purchase products from The Gift Whisperer through our website. Please read them carefully before placing an order.
By placing an order with us, you agree to these Terms & Conditions.
1. About Us
The Gift Whisperer is an independent UK business selling thoughtfully curated gifts, creative rituals and everyday rituals.

2. Our Products
We take care to describe and photograph our products as accurately as possible.
Because some items are handmade, hand-finished or made using natural materials, there may be small variations in colour, texture, finish or appearance.
These individual variations are part of the character of the product and are not necessarily faults.
Colours may also appear slightly different depending on your screen or device.
Nothing in this section affects your statutory rights if goods are faulty, not as described or otherwise fail to meet the standards required by law.
3. Placing an Order
After placing your order, you'll receive an email confirming that we have received it.
A contract between you and The Gift Whisperer is formed when you complete checkout and we send you an order confirmation email.
If we're unable to accept your order, we'll let you know and refund any payment already taken.
4. Prices & Payment
All prices are shown in pounds sterling (£).
The total price of your order, including any applicable delivery charges, will be shown before you complete your purchase.
Payment must be made using one of the payment methods available at checkout.
We take reasonable care to ensure prices are correct. If we discover an obvious pricing error after you place an order, we’ll contact you before fulfilling it.
5. Delivery
Our current UK Standard Delivery charge is £3.99, with free standard delivery on orders over £25.
Our estimated dispatch time is within 5 working days, with delivery usually within 7 working days, unless a different timescale is stated on the relevant product page.
Delivery estimates may occasionally be affected by circumstances outside our reasonable control.

6. Your Right to Cancel
For eligible online purchases, you normally have 14 days from receiving your goods to tell us that you wish to cancel the contract without giving a reason. You then have a further 14 days to return the goods.
To exercise your right to cancel, contact us at hello.thegiftwhisperer@gmail.com with a clear statement that you wish to cancel.
You may use the model cancellation form provided below, but you do not have to use it.

7. Exceptions to the Right to Cancel
The statutory right to cancel does not apply to certain products, including goods that are made to your specifications or clearly personalised.
It may also not apply to sealed goods that are not suitable for return for health protection or hygiene reasons once they have been unsealed.
Where an exception applies to a product, we will make this clear on the relevant product page before you place your order.
These exceptions do not affect your rights where goods are faulty, damaged, not as described or otherwise do not meet the requirements of consumer law.
8. Returns & Refunds
If you change your mind about an eligible purchase, you are responsible for the direct cost of returning the unwanted goods to us.
If you cancel an entire eligible order within the statutory cancellation period, we'll refund the standard outbound delivery charge you paid. If you chose a more expensive delivery method, we're only required to refund up to the cost of our least expensive standard delivery option.
If goods are faulty, damaged or incorrect, we'll work with you to put things right and arrange the return where required.

9. Faulty Goods
Your products must meet the standards required by UK consumer law, including being of satisfactory quality, fit for purpose and as described.
Nothing in these Terms & Conditions limits your statutory rights.
The Consumer Rights Act provides remedies for faulty goods, including a short-term right to reject in qualifying circumstances and subsequent repair/replacement rights.
10. Product Availability
All products are subject to availability.
Occasionally, an item may become unavailable after an order has been placed. If this happens, we'll contact you as soon as possible and refund any amount paid for an item we cannot supply.
11. Promotions & Discount Codes
Any promotions, discount codes or special offers are subject to the terms stated with the relevant promotion.
Unless otherwise stated, promotional codes cannot be exchanged for cash.
We reserve the right to withdraw a promotion where necessary, provided doing so does not unfairly affect an order we've already accepted.
12. Our Responsibility to You
We are responsible for foreseeable loss or damage caused by our breach of these Terms or our failure to use reasonable care and skill.
Nothing in these Terms excludes or limits liability where it would be unlawful to do so, including liability that cannot legally be excluded under consumer law.
These Terms do not affect your statutory rights. Consumer contract terms must be fair, and businesses cannot contract out of responsibilities for matters such as faulty or misdescribed goods.

We use your personal information in accordance with our Privacy Policy.
Our use of cookies and similar technologies is explained in our Cookie Policy.
14. Changes to These Terms
We may update these Terms & Conditions from time to time, for example if our services, policies or applicable law change.
The Terms that apply to your purchase will be those in force when your order is placed.
14. Governing Law
These Terms & Conditions are governed by the laws applicable in England and Wales.
Nothing in this section deprives a consumer living elsewhere in the UK of any mandatory protections or rights available to them under applicable law.
